SIMPLY SOFT PLAY LIMITED
TERMS & CONDITIONS
Effective Date: 27 June 2026
These Terms & Conditions apply to the hire of inflatable, soft play and children's party equipment supplied by Simply Soft Play Limited (“we”, “us”, “our”).
By making a booking, the hirer (“you”, “your”) confirms that they have read, understood and agreed to these Terms & Conditions.
1. BOOKINGS, DEPOSITS & PAYMENT
A £30.00 deposit is required to secure a booking unless otherwise agreed in writing.
A booking is not confirmed until the required deposit has been received and the booking has been confirmed by Simply Soft Play Limited.
If the deposit is not received within 48 hours, we reserve the right to release the requested date and equipment.
The deposit forms part of the total hire price.
The remaining balance must be paid in full before the equipment is used, unless otherwise agreed in writing.
Payment methods
We accept:
- Cash
- Bank Transfer (BACS)
2. CONSUMER RIGHTS & COOLING-OFF PERIOD
Where applicable, consumer protection legislation will apply to your booking.
Certain leisure services supplied on a specific date or during a specific period may be exempt from the usual 14-day cancellation right under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
Nothing in these Terms & Conditions removes or restricts any statutory rights that cannot legally be excluded.
3. DELIVERY, SET-UP & COLLECTION
We will deliver, set up and collect equipment at the agreed location and within the agreed arrangements.
The hirer must ensure:
- Safe and adequate access for delivery.
- A suitable, safe and reasonably level setup area.
- The area is clear of sharp objects, glass, animal fouling, rubbish and other hazards.
- There are no unsuitable overhead obstructions.
- The equipment will fit safely within the available space.
- Any necessary permission to use the property or venue has been obtained.
The hirer is responsible for providing accurate information about access and the setup area.
If the location or access is unsafe or materially different from the information provided, we may refuse or postpone setup.
Where the problem is caused by the hirer, we may retain or charge an amount reasonably necessary to cover costs and losses actually incurred.
Where the problem is outside the hirer's control, we will deal with the situation fairly and, where appropriate, offer an alternative arrangement or refund.
Collection times are agreed in advance.
Delays caused by the hirer may result in an additional reasonable charge where we incur additional costs or staff time.
4. POWER SUPPLY
Where mains electricity is required, the hirer must provide access to a safe and suitable power supply within a reasonable distance of the setup area.
We may provide extension leads where agreed.
The hirer must not disconnect, alter or interfere with electrical equipment supplied by us.
Where appropriate, electrical equipment will be appropriately tested and RCD protection may be used.
If the available power supply is unsafe or unsuitable, we may refuse to operate the equipment until a safe alternative is available.
5. USE OF EQUIPMENT & SUPERVISION
The hirer is responsible for ensuring the equipment is used safely throughout the hire period.
Children must be supervised by a responsible adult at all times.
Users must:
- Follow all safety instructions.
- Follow safety signage.
- Be suitable for the equipment's age and size requirements.
- Stay within the maximum permitted capacity.
- Use the equipment only for its intended purpose.
- Avoid rough or dangerous behaviour.
Users should be grouped according to similar age and size where appropriate.
The maximum number of users will depend on the equipment hired.
6. PROHIBITED ITEMS & ACTIVITIES
The following are prohibited unless specifically agreed otherwise:
- Food
- Drinks or liquids
- Chewing gum
- Face paint
- Glitter
- Confetti
- Silly string
- Sharp objects
- Jewellery that could damage equipment
- Glass objects
- Pets or animals
- Smoking or vaping
- Barbecues
- Naked flames
- Candles
- Fireworks
Shoes and other items must be removed where required by the equipment's safety instructions.
7. INFLATABLE EQUIPMENT
Inflatables must:
- Remain in their installed position.
- Remain correctly anchored.
- Not be moved by the hirer.
- Not be altered or modified.
- Not be overloaded.
- Not be used if they become unsafe or damaged.
The blower must remain operating while the inflatable is in use.
The hirer must not switch off, disconnect or interfere with the blower.
If an inflatable deflates, loses pressure or develops a fault, all users must leave immediately and Simply Soft Play Limited must be contacted.
The equipment must not be used again until it has been confirmed safe.
8. WEATHER & WIND CONDITIONS
Inflatable equipment must only be operated within the safe conditions specified by the manufacturer and applicable safety guidance.
Inflatables must not be operated when wind speeds or gusts exceed the manufacturer's maximum safe operating limit.
Where equipment has a 24mph maximum operating limit, operation must cease if wind speeds or gusts reach or exceed 24mph.
We may stop operation before the maximum limit is reached where we reasonably believe conditions are becoming unsafe.
Wind conditions may be monitored using a suitable anemometer.
Inflatables must not be used where weather conditions make operation unsafe, including:
- Excessive wind
- Heavy rain where unsafe
- Thunderstorms
- Lightning
- Other hazardous weather conditions
If equipment becomes wet or unsafe, use must stop.
Weather cancellation by Simply Soft Play Limited
If we cancel because weather conditions make operation unsafe, we will offer:
Option 1 – Full refund of amounts paid
or
Option 2 – Alternative date, subject to availability
Customer cancellations made solely because of an unfavourable weather forecast, where we have not cancelled the booking, are dealt with under the standard cancellation policy.
9. SOFT PLAY, BALL PONDS & GAMES
Soft play, ball ponds, giant games and other party equipment must only be used for their intended purpose.
The hirer must ensure:
- Children are supervised.
- Equipment is not dragged or moved.
- Equipment is not used outside unless specifically approved.
- Food and drinks are kept away.
- Equipment is not deliberately damaged.
- Components are used correctly.
Missing, damaged or excessively soiled items may result in reasonable additional charges.
10. EQUIPMENT MUST NOT BE MOVED OR ALTERED
The hirer must not:
- Move equipment.
- Dismantle equipment.
- Repair equipment.
- Alter equipment.
- Remove safety features.
- Move anchors, mats or blowers.
- Add attachments.
- Allow another person or company to repair or move the equipment.
Contact Simply Soft Play Limited if equipment needs to be moved.
11. FAULTS & EMERGENCIES
Any fault, damage, unusual noise, electrical issue, loss of pressure or safety concern must be reported immediately.
Equipment must not continue to be used where doing so could be unsafe.
The hirer must take reasonable steps to protect users and prevent further damage.
12. DAMAGE, LOSS & CLEANING
Responsibility for the equipment passes to the hirer from delivery/acceptance until collection.
The hirer must take reasonable care of the equipment.
Reasonable charges may apply where damage, loss or excessive cleaning results from:
- Misuse
- Negligence
- Failure to follow instructions
- Deliberate damage
- Unauthorised movement
- Food or drink
- Pets or animals
- Other avoidable damage
Any repair or replacement charge will be reasonable and proportionate to the loss suffered.
Where appropriate, supporting evidence such as a quotation or invoice may be provided.
13. CLEANING & HYGIENE
Equipment is checked and cleaned between hires as appropriate.
Customers must take reasonable steps to prevent unnecessary contamination, staining and excessive soiling.
Additional reasonable cleaning, drying or sanitising charges may apply where equipment requires substantially more cleaning than normal use would reasonably cause.
14. CUSTOMER CANCELLATIONS
Our cancellation policy is designed to provide clear notice periods while ensuring that any amount retained is reasonable and proportionate.
The cancellation period is calculated from the agreed hire date and start time.
More than 3 days (72Hrs) before hire
Normally:
Full refund of all amounts paid, including the £30 deposit.
Under 3 days (Less than 72Hrs) before hire
The £30 deposit may be retained.
Any additional amount retained will only be an amount reasonably necessary to cover direct losses and costs resulting from the cancellation that cannot reasonably be avoided.
Within 24 hours
We may retain an amount reasonably necessary to cover actual and reasonably foreseeable losses caused by the cancellation.
This may include reasonable preparation, staffing, travel, delivery or other costs already incurred.
We will not automatically retain the full hire price.
Same-day cancellation or failure to provide access
We may retain an amount reasonably necessary to cover the actual loss caused by the cancellation or failed delivery.
This does not automatically mean that the full hire price will be retained.
Re-hiring the booking
Where we successfully re-hire the same equipment for the same date, this will be taken into account when calculating any amount reasonably retained.
We will take reasonable steps to minimise our losses.
15. DATE CHANGES
Date changes are subject to availability.
We will make reasonable efforts to transfer a booking to another available date.
Any difference in hire price may apply.
Last-minute date changes may not be possible and may be treated as cancellations where appropriate.
16. CANCELLATION BY SIMPLY SOFT PLAY LIMITED
We may cancel or refuse to proceed where:
- Equipment cannot be operated safely.
- Weather conditions are unsafe.
- The setup area is unsuitable.
- Incorrect information has been provided.
- Required access is unavailable.
- Equipment has suffered unforeseen damage or failure.
- Important safety requirements have not been followed.
- Continuing would create an unreasonable safety risk.
Where we cancel for reasons outside the hirer's control, we will normally offer a full refund or alternative date.
Where cancellation is caused by the hirer's actions, reasonable costs or losses may be retained.
17. INSURANCE & LIABILITY
Simply Soft Play Limited holds Public Liability Insurance up to £5 million.
Proof of insurance can be provided upon reasonable request.
The hirer remains responsible for appropriate supervision and safe use.
Nothing in these Terms & Conditions excludes or limits liability that cannot legally be excluded.
Nothing excludes liability for:
- Death or personal injury caused by negligence.
- Fraud or fraudulent misrepresentation.
- Any other liability that cannot legally be excluded.
Nothing in these Terms & Conditions removes or restricts the customer's statutory rights.
18. FORCE MAJEURE
We are not responsible for delays or failure to perform caused by circumstances outside our reasonable control.
This may include:
- Severe weather
- Flooding
- Fire
- Government restrictions
- Emergency situations
- Road closures
- Major transport disruption
- Serious equipment failure
- Utility failure outside our control
We will communicate with the hirer and seek to provide a reasonable alternative or refund where appropriate.
19. OVERNIGHT HIRE
Where equipment remains at the hirer's property overnight, the hirer remains responsible until collection.
The equipment must be protected from:
- Theft
- Damage
- Unauthorised use
- Animals
- Weather
- Other foreseeable risks
Inflatables must not be used outside the agreed hire period.
20. EQUIPMENT REMAINS OUR PROPERTY
All equipment supplied remains the property of Simply Soft Play Limited.
The hirer must not:
- Sell the equipment.
- Sub-hire it.
- Lend it.
- Move it without permission.
- Modify it.
- Repair it.
- Remove safety information or company identification.
21. VENUES & THIRD-PARTY PREMISES
Where equipment is hired for a hall, school, community centre or other venue, the hirer must comply with the venue's rules.
The hirer is responsible for obtaining any required permission.
Venue requirements do not replace these Terms & Conditions.
22. COMPLAINTS
If you have a complaint about our service or equipment, please contact us as soon as reasonably possible.
We will investigate complaints fairly and aim to resolve genuine concerns promptly.
23. CHANGES TO THESE TERMS
We may update these Terms & Conditions from time to time.
The version applicable to a confirmed booking will normally be the version provided to the customer when the booking was made.
Changes after confirmation will not normally alter an existing booking unless required by law or agreed with the customer.
24. SEVERABILITY
If any provision is found to be invalid, unlawful or unenforceable, the remaining provisions will continue to apply.
25. GOVERNING LAW
These Terms & Conditions are governed by the laws of England and Wales.
Nothing prevents a consumer from relying on mandatory legal rights or protections.
26. ENTIRE AGREEMENT
These Terms & Conditions, together with the booking confirmation and any specific written arrangements agreed with the customer, form the agreement between Simply Soft Play Limited and the hirer.
27. BY BOOKING WITH US, YOU CONFIRM:
- You have read and understood these Terms & Conditions.
- You agree to follow all safety instructions.
- You will ensure appropriate supervision.
- You will use equipment only for its intended purpose.
- You will not move, alter or repair equipment.
- You will report faults or safety concerns immediately.
- You will take reasonable care of the equipment.
- You have provided accurate delivery and setup information.
- You have obtained any necessary venue permission.
